Las capitulaciones Matrimoniales en el Proyecto de Reforma de Codigo Civil

Abstract

Capitulación matrimonial es un convenio celebrado por los futuros esposos con el objeto de determinar el régimen patrimonial al que habrán de someterse durante el matrimonio o bien precisar algún aspecto de sus relaciones patrimoniales futuras. El objeto de la capitulación puede variar según la mayor o menor amplitud que le acuerde el derecho positivo. Así, en cuanto a la elección del régimen, las alternativas pueden ser desde escoger entre uno de los propuestos por la ley, hasta elaborar un particular sistema patrimonial que resultará eficaz en tanto no contraríe el orden público establecido. Puede reglarse, por ejemplo, la propiedad y gestión de los bienes e ingresos de cada esposo, la responsabilidad por deudas, el modo de partir los bienes a la extinción del régimen, los porcentajes que habrá de atribuirse cada uno, las compensaciones económicas, etc..
