Abstract

A través de regular específicamente el proceso de quiebra dentro de la Ley de Concursos y Quiebras, se persigue la finalidad primordial de organizar de forma legal, colectiva y general a todos los acreedores del deudor que se ha declarado fallido, con el objeto de integrar, depurar y conservar el patrimonio de dicho deudor insolvente, para liquidarlo de la mejor y más eficiente manera posible, haciendo efectivo el principio de igualdad de tratamiento. No obstante de que la quiebra en su regulación legislativa tiene un marcado carácter procesal, contiene también una parte muy importante de derecho sustancial o de fondo. Tratándose la quiebra de un proceso netamente liquidatorio, la Ley 24.522 ha adoptado, respecto de dicha institución, una tendencia clara que persigue la realización de los bienes, de la manera más adecuada posible, en beneficio de la masa y de la comunidad de intereses vinculados a la empresa.
