O direito da moda, apesar de novo, têm vindo a crescer, e por isso, torna-se interessante perceber no que consiste este direito recente. O objetivo da presente dissertação consiste no estudo da melhor solução jurídica para proteger as coleções dos designers. Ao longo da minha dissertação irei abordar algumas das figuras consideradas relevantes para uma melhor segurança jurídica na indústria da moda. Estas figuras passam pelo âmbito da propriedade intelectual. Dentro desta, destacarei o direito de autor, e as algumas das áreas da propriedade industrial, tais como: - a patente e modelos de utilidade; os desenhos ou modelos, e por fim, a marca. Interessa estudar como a propriedade intelectual se relaciona com a moda e quais os entraves que a propriedade intelectual impõe à indútria da moda. E, por fim, uma breve referência sobre o impacto da pirataria no sector.

Fashion law, despite being new, has been growing, and therefore, it is interesting to understand what this recent law consists of. The objective of this dissertation is to study the best legal solution to protect designers' collections. Throughout my dissertation I will address some of the figures considered relevant for better legal certainty in the fashion industry. These figures pass through the scope of intellectual property. Within this, I will highlight copyright, and some of the areas of industrial property, such as: - patents and utility models; the designs or models, and finally, the brand. It is interesting to study how intellectual property relates to fashion and what obstacles intellectual property imposes on the fashion industry. And, finally, a brief reference on the impact of piracy in the sector.
