El empleador plural, el empleador complejo y el empleador instrumental en las redes empresariales

Abstract

O estudo explora as diversas questões das quais resulta a possibilidade, dentro da nova realidade económica e produtiva marcada pelo apogeu de formas de colaboração interempresarial, de atribuir a mais de um sujeito a condição de empregador ou empresário de um ou mais trabalhadores. Para tal, o estudo explora a tradição normativa e jurisprudencial espanhola, que não é alheia ao reconhecimento da hipótese de empregador plural, assim como do texto do artigo 1.º, n.º 2, do estatuto dos trabalhadores, que introduz esta figura na ordem jurídica espanhola, embora de forma implícita, mas não duvidosa.

The study explores the various issues that allow for the possibility, within a new economic and productive reality marked by the pinnacle of types of inter-company collaboration, to attribute to more than one subject the status of employer or entrepreneur of one or more employees. To this end, the study explores the Spanish normative tradition and jurisprudence, which is not unfamiliar to the recognition of the idea of plural employer, and the text of Article 1, paragraph 2 of the workers’ statute, which introduces this figure indisputably, although implicitly, in the Spanish legal system.

El estudio explora los distintos supuestos en los cuales resulta posible, dentro de la nueva realidad económica y productiva emergente, marcada por el auge de las formas de colaboración interempresarial del carácter reticular, atribuir a más de un sujeto la condición de empleador o empresario de uno o más trabajadores. Para ello parte de la tradición normativa y jurisprudencial española, que no es ajena al reconocimiento de supuestos de empleador plural, así como del texto del artículo 1.2 del estatuto de los trabajadores, que introduce de forma implícita pero no dudosa esta figura.
