Abstract

Os acidentes de trabalho são, infelizmente, uma figura muito conhecida dos trabalhadores portugueses e não só. Actualmente entende-se como acidente de trabalho o que ocorra durante o tempo e no local de trabalho e que produza uma lesão corporal, perturbação funcional ou uma doença e que por sua vez se traduz num dano, ou seja, na diminuição da capacidade de trabalho, de ganho ou na morte. Contudo, nem sempre os acidentes de trabalho ocorrem durante o tempo de trabalho e muito menos no local de trabalho. A Lei admite, nestes termos, as extensões ao conceito de acidente de trabalho, designadamente os acidentes de trabalho in itinere. Os acidentes de trabalho in itinere têm origem na jurisprudência mas foram depois adoptados pelas legislações dos vários países. Estes acidentes são verdadeiros acidentes de trabalho não consistindo numa figura autónoma, seguindo, assim, o mesmo regime que os acidentes de trabalho propriamente ditos. Assim, entende-se por acidente de trabalho in itinere o que ocorre no trajecto de ida e de regresso para o local de trabalho. Nos nossos dias, o acidente de trabalho in itinere é um problema que surge quase diariamente e que tem originado variadíssima jurisprudência, embora não seja tão estudado pela doutrina que se tem esquecido desta questão.

Abstract: Work accidents are unfortunately a well-known Portuguese workers and not only figure. Currently it is understood as occupational accident which occurs during the time and in the workplace that produces an injury, functional disorder or disease and that in turn is resulting in damage, ie, decreased ability to work , gain or death. However, not always work accidents occur during work time and much less in the workplace. The Act acknowledges these terms, the extensions to the concept of work accidents, including accidents at work in itinere. Work accidents in itinere comes in case law but were later adopted by the laws of various countries. These accidents aren’t true accidents consisting of an autonomous figure, thus following the same regime that the accidents themselves. Thus, the term work accident in itinere which occurs in the outward journey and return to the workplace. Nowadays, the work accident in itinere is a problem that arises almost daily and that has caused very varied jurisprudence, although not as studied by the doctrine that has been overlooked this issue.
