La proporcionalidad del despido: la razonabilidad de una sanción

Abstract

En el ámbito laboral, la razonabilidad de las decisiones empresariales exige al empleador tratar al trabajador con consideración a su dignidad humana y con el respeto y cordialidad que exige la misma empresa para con los clientes. En este artículo se analiza el concepto de razonabilidad en relación al poder sancionador del empresario. Se destaca que, por ley, las empresas deben redactar un reglamento interno en el que se especifique qué conductas están prohibidas. Además, se hace hincapié en el hecho de que las sanciones recibidas deben ser proporcionales a las faltas cometidas.
