Abstract

A continuación se presenta una análisis de una de las normas constitucionales adscriptas creadas por el TC en la sentencia al EXP. N.° 3741-2004-PA/TC, y que con el ropaje de precedente vinculante, disponía la posibilidad de que determinadas instancias administrativas pudiesen inaplicar normas infraconstitucionales.
