El artículo explica las incorrecciones en cómo el Tribunal Constitucional ha ido empleando el precedente vinculante constitucional, las cuales llegan a ser precedentes vinculantes sin contenido jurídico, formalmente constitucionales y materialmente inconstitucionales, o aquellos que son simples propuestas no vinculantes.
