Abstract

MEDIANTE EL PRESENTE TRABAJO DE FIN DE GRADO SE BUSCA DAR RESPUESTA A UNA SITUACIÓN COMPLEJA COMO ES LA RESPONSABILIDAD EN SEDE CONCURSAL POR CONDUCTAS CONTRARIAS AL DEBER DE DILIGENCIA Y CUANDO, ESAS CONDUCTAS PUEDEN SUPONER UN DOBLE REPROCHE ACUDIENDO AL PROCESO PENAL. PARA ELLO SE ANALIZA POR UN LADO, LOS ACTOS QUE HACEN DEVENIR EL CONCURSO COMO CULPABLE Y LAS RESPONSABILIDADES QUE ESO CONLLEVA, Y POR OTRO, SE DESCRIBEN AQUELLOS DELITOS RECOGIDOS EN EL CÓDIGO PENAL RELATIVOS A LA INSOLVENCIA PUNIBLE. EL TRABAJO CULMINA CON LA COMPARACIÓN DE PRECEPTOS QUE, A LA LUZ DE LA JURISPRUDENCIA, PUEDEN SUPONER ESE DOBLE REPROCHE, SUPONIENDO EL RESTO UNOS LÍMITES QUE SOLO SE CASTIGARÁN, BIEN EN EL PROCESO CONCURSAL O BIEN ANTE EL ÓRGANO JURISDICCIONAL PENAL.
