Las prerrogativas parlamentarias de las Cortes Generales: El aforamiento en el Parlamento Español

Abstract

Las prerrogativas se encuentran reguladas tanto en España como en el resto de estados de nuestro alrededor, a salvedad de la figura del aforamiento que no se instaura en algunos estados, o es concedida de forma más limitada. La inviolabilidad y la inmunidad son prerrogativas extraídas del artículo 71 de la Constitución española que ayudan a proporcionar un buen funcionamiento del Parlamento, mientras que el aforamiento, también recogida en la Constitución, ha surgido como medida para asegurar la independencia de la institución. Según parte de la doctrina, y parte de la ciudadanía, el aforamiento es un sistema diferenciado que carecería de justificación, atentando así, contra el Principio de Igualdad. Al final observamos como estas cuestiones han hecho mella, no sólo en la ciudadanía, sino también en el ámbito político, porque a lo largo de este último año es cuando más menciones políticas se han hecho a raíz de la entra en juego de Ciudadanos, partido que ha intentado introducir poco a poco la eliminación de los aforados.

Prerogatives are regulated both in Spain and in the rest of the states around us, except for the figure of assessment that is not established in some states, or is granted in a more limited way. Infringement and immunity are prerogatives drawn from Article 71 of the Spanish Constitution, which help to ensure a proper functioning of Parliament, while the provision, also enshrined in the Constitution, has emerged as a measure to ensure the independence of the institution. According to part of the doctrine, and part of the citizenship, empowerment is a differentiated system that would lack justification, thus attacking against the Equality Principle. In the end we see how these issues have made a dent, not only in citizenship, but also in the political arena, because during the last year is when more political mentions have been made following the entry of Citizens, party Which has tried to gradually introduce the elimination of the measures.
