El beneficiario en el seguro de vida

Abstract

Este TFG sobre el “Beneficiario en el seguro de vida” se enfoca en analizar dicha figura con carácter general y en abordar de una manera más específica el papel que desempeñan las parejas de hecho en esta categoría de seguros. En primer lugar, nos centraremos en indicar en qué categoría se encuentran, sus características, especialidades y principales diferencias con otros seguros. Brevemente, comentaremos los elementos que aparecen en el contrato, centrándonos en el beneficiario. En la segunda parte del trabajo, estudiaremos la figura del beneficiario señalando su evolución histórica, su concepto, la naturaleza del derecho que se origina, su capacidad, su determinación y designación y, finalmente, su revocación. Por último, mencionaremos el especial caso de las parejas de hecho, la evolución conceptual que ha sufrido tanto doctrinal como jurisprudencialmente y su equiparabilidad con la institución del matrimonio. Esta última cuestión de gran controversia se resolverá a través de las distintas resoluciones judiciales tanto del Tribunal Supremo como de la Audiencia Nacional.

This work about the “Beneficiary in life insurance” focuses on analyzing this figure in general and addressing in a more specific way the role played by de facto couples in this insurance category. First, we will focus on indicating what category they are in, their characteristics, specialties and main differences with other insurances. Briefly, we will comment on the elements that appear in the contract, focusing on the beneficiary. In the second part of the work, we will study the figure of the beneficiary indicating its historical evolution, its concept, the nature of the law that originates, its capacity, its determination and designation and, finally, its revocation. Finally, we will mention the special case of the de facto couples, the conceptual evolution that has suffered both doctrinally and jurisprudentially and its equivalence with the institution of marriage. This last question of great controversy will be resolved through the different judicial resolutions from both the Tribunal Supremo and the Audiencia Nacional institutions.
