El presente trabajo tiene por objeto, realizar un estudio y análisis de la legislación y jurisprudencia, al respecto de la figura jurídica conocida como guarda y custodia compartida. Inicialmente haremos una diferenciación conceptual de la patria potestad y, guarda y custodia, pues especial importancia reviste diferenciarlos, dado que en cualquier procedimiento judicial, de separación, nulidad o divorcio, en el que hay menores, habrá que determinar quienes la ejercerán. Describiremos que se entiende por custodia compartida. Seguiremos con un repaso de la normativa internacional más relevante, que ha servido de base e inspiración al legislador. Posteriormente haremos un análisis desde el derecho comparado, de países de nuestro entorno europeo, como son Francia, Alemania, Portugal e Italia. Seguidamente se analiza la regulación de la custodia compartida en nuestro código civil, empezando por la situación anterior a la reforma de 2005, para avanzar hacia el cambio producido, con posterioridad a dicha reforma. Seguido de un análisis de la jurisprudencia del Tribunal Supremo, distinguiendo entre los criterios a tener en cuenta para la concesión y exclusión, de la custodia compartida. Comentaremos el Anteproyecto de ley sobre el ejercicio de la corresponsabilidad parental y otras medidas a adoptar tras la ruptura de la convivencia. Para continuar con un análisis legislativo de las comunidades autónomas con legislación propia, que son Cataluña, Navarra, Aragón, C. Valenciana y País Vasco. Para finalizar con las conclusiones alcanzadas del análisis realizado.

The purpose of this paper is to conduct a study and analysis of the legislation and jurisprudence regarding the legal concept known as guardianship and joint custody. Initially, we will make a conceptual differentiation between custody and guardianship, since it is especially important to differentiate them given that in any legal procedure of separation, nullity or divorce in which there are minors involved it will be necessary to determine who it will be awarded to. We will start by describing what is understood by joint custody and then proceed by reviewing some of the most relevant international regulations, which have served as the basis and inspiration for legislators. Later we will make an analysis from the contrastive law of countries in our European environment, such as France, Germany, Portugal and Italy. Next, the regulation of joint custody in our civil code is analyzed, beginning with the situation prior to the 2005 reform and then moving towards the change produced after said reform. We will continue with an analysis of the jurisprudence of the Supreme Court, examining the criteria to be taken into account for awarding or exclusion of joint custody. We will comment on the draft bill on the exercise of parental responsibility and other measures to be considered after the break of coexistence. We will follow by an analysis of the autonomous communities with their own legislation, which are Catalonia, Navarre, Aragon, Valencia and the Basque Country. We will end by exposing the conclusions reached after the analysis carried out.
