A partir del año 2001 se ha producido en nuestro ordenamiento jurídico el desarrollo legislativo de las voluntades anticipadas. Actualmente, todas las Comunidades Autónomas tienen su propia normativa que convive con la Ley básica reguladora de la autonomía del paciente y de derechos y obligaciones en materia de información y documentación clínica. Todo ello ha contribuido a la existencia de una considerable disparidad normativa que ha traído consigo importantes desajustes, también en torno a la formalización y el otorgamiento de los documentos donde se recogen dichas voluntades.

Since 2001, the legislative development of advance directives has taken place in our legal system. Currently, all the Autonomous Communities have their own regulations that coexist with the Basic Act regulating patient autonomy and the rights and obligations regarding clinical information and documentation. All this has contributed to the existence of a considerable disparity in regulations, which has led to significant imbalances, also with regard to the formalisation and execution of the documents containing the advance directives.
