This paper aims to analyze the complex relationship between freedom of expression and linguistic rights in the Valencian Community, demonstrating that, although both rights share a common foundation in human dignity and free communication, they may come into indirect conflict when the unbalanced exercise of one endangers the real effectiveness of the other. Through an examination of the legal framework, the sociolinguistic context of the Valencian language, and relevant case law, it becomes evident that the formal recognition of rights does not always guarantee their material effectiveness, particularly in contexts of linguistic marginalization.
Aquest treball pretén analitzar la complexa relació entre la llibertat d’expressió i els drets lingüístics a la Comunitat Valenciana, demostrant que, tot i compartir un fonament comú en la dignitat humana i la comunicació lliure, aquests drets poden entrar en col·lisió indirecta quan l’exercici desequilibrat d’un d’ells posa en perill l’efectivitat real de l’altre. A través de l’estudi del marc normatiu, el context sociolingüístic del valencià i l’anàlisi jurisprudencial, s’ha posat de manifest que la protecció formal dels drets no sempre garanteix la seua efectivitat material, especialment en contextos de minimització lingüística.
