Obligaciones "to achieve a specific result" y "of best efforts": perspectiva romanística de la sistematización de los principios UNIDROIT y DFCR

Abstract

La acogida por parte de los principales instrumentos del denominado “Soft law” de la clasificación de las obligaciones que distinguía entre las denominadas “obligations de moyen” y las “obligations de résultat”, ha reavivado la amplia polémica doctrinal que se había suscitado en su día en torno a numerosas cuestiones y que se había abandonado por falta de consenso al respecto. El estudio de las fuentes de Derecho romano, en las que se refleja claramente la presencia de obligaciones que incluían la obtención de un resultado, aporta una perspectiva distinta para la reflexión de todas las cuestiones que permanecen en la actualidad abiertas a la discusión en esta materia.

The main soft law instruments have accepted the classification of obligations offered by Demogue in its Traité des obligations en générale, which distinguished between “obligations de moyen” and “obligations de résultat”. With this reception, the doctrinal controversy that arose in its day around numerous issues and that had been abandoned due to lack of consensus on the matter has been revived. The study of the sources of Roman Law that reflect the obligations that included obtaining a result, provides a different perspective for the reflection of all the questions that remain open to discussion.
