Los sistemas de inteligencia artificial, ¿productos defectuosos?

Abstract

Para comenzar, por más obvio que parezca, hemos de señalar que la in- corporación de la inteligencia artificial comporta innegables aspectos positivos, pero también importantes retos. Su naturaleza sui generis, su complejidad y la imposibilidad para conocer, a priori, la actuación de la máquina, han provocado que se plantee la necesidad de aprobar una normativa específica. Y es que, las reglas tradicionales no se adaptan adecuadamente a esta nueva realidad. Piénsese, por ejemplo, en la responsabilidad por hecho ajeno y la atribución de culpa. En este sentido, la estrategia europea parte de tres bloques de actuaciones. De un lado, aparecen las denominadas normas horizontales sobre los sistemas de inteligencia artificial, cuyo máximo exponente se identifica con el Reglamento del Parlamento Europeo y del Consejo, de 21 de abril de 2021 (en adelante, Ley de Inteligencia Artificial. Esta última, a través de los requisitos, condiciones, exigencias y, en particular, a partir de la clasificación de los sistemas, incorpora una suerte de principios que tratan de evitar (o, al menos, reducir), los daños producidos como consecuencia del uso de tecnología
