Abstract

Mientras las videograbaciones que realizan las Fuerzas y Cuerpos de Seguridad deben cumplir una normativa que autorice su uso y su posterior tratamiento de datos, preservando los derechos fundamentales de las personas para que puedan ser utilizadas como medio de prueba o para la propia defensa ante el empleo de la fuerza, nos encontramos que al amparo actual de las nuevas tecnologías las imágenes captadas por los particulares en el ámbito “personal y doméstico”, y según en qué casos, también deberían estar sujetas a su tratamiento y control normativo conforme a los propios principios del derecho a la intimidad y a la propia imagen. El volumen de captaciones audiovisuales y su difusión instantánea en redes sociales debido especialmente a las tecnologías de la telefonía móvil está dificultando su control y el tratamiento restrictivo de las imágenes; en función de quien las obtenga. Esta desproporción en el cumplimiento normativo, junto con los juicios de valor partidistas o interesados y las opiniones dispares sobre las actuaciones policiales generan desconcierto e inseguridad jurídica entre los agentes de dicho colectivo. La pretensión del trabajo es presentar la dificultad actual de las Fuerzas y Cuerpos de Seguridad en aportar imágenes como medio de prueba en su defensa, la influencia de las grabaciones en su actividad cotidiana; ante este “Gran Hermano” de la sociedad actual y la justificación del uso de la fuerza ante una sociedad políticamente crítica. La temática se desarrolla mediante la investigación normativa y procedimental, la aportación práctica de videograbaciones audiovisuales difundidas por internet y la justificación del empleo de cámaras por parte de las Fuerzas y Cuerpos de Seguridad como medio de prueba en sus actuaciones.

While the video recordings made by the Security Forces and Corps must follow regulations that authorize their use and later data processing, preserving the fundamental rights of individuals so that they can be used as evidence or for self-defense against the use of force, we find that under the current protection of new technologies, images captured by individuals in the "personal and domestic" sphere, and depending on the case, should also be subject to processing and regulatory control in accordance with the principles of the right to privacy and the right to a personal image. The volume of audiovisual recordings and their instantaneous dissemination on social networks, especially due to mobile phone technologies, is making it difficult to control and restrict the treatment of images, depending on who obtains them. This lack of proportion in regulatory compliance, combined with partisan or self-interested value judgements and differing opinions on police actions, generates confusion and legal uncertainty among police officers. The aim of the work is to present the current difficulty of the Security Forces and Corps in providing images as a means of evidence in their defense, the influence of the recordings in their daily activity; in the face of this "Big Brother" of today's society and the use of force as a justification in a politically critical society. The subject is developed through normative and procedural research, the practical contribution of audiovisual video recordings disseminated on the internet and the justification of the use of cameras by the security forces as a means of evidence in their actions.
