El consentimento informado en el ámbito sanitario: la lex artis y los derechos fundamentales

Abstract

El consentimiento informado ha conllevado un cambio de paradigma en la profesión sanitaria. La legislación española actual reconoce y ampara el derecho de todo paciente a poder decidir libre y voluntariamente en el ámbito de su salud. En este sentido, los usuarios de centros médicos han de ser informados y han de ejercitar el consentimiento. Todo ello provoca que, a pesar de que un profesional cumpla con el resto de sus obligaciones médicas (lex artis tradicional), se le pueda exigir responsabilidad por conculcar el consentimiento informado de los pacientes (nova lex artis). Este trabajo se centra en el régimen legal español del consentimiento informado, así como en la jurisprudencia y doctrina más relevante.

Informed consent has led to a paradigm shift in the health profession. The current Spanish legislation recognizes and protects the right of all patients to be able to decide freely and voluntarily in the field of their health. In this sense, the users of medical centres must be informed and have to exercise their consent. All this causes that, despite the fact that a professional complies with the rest of his medical obligations (traditional lex artis), he may be held responsible for circumventing the informed consent of the patients (nova lex artis). This work focuses on the Spanish legal regime of informed consent, as well as on the most relevant jurisprudence and doctrine
