Este trabajo está orientado a la investigación de las diferentes situaciones que se pueden producir cuando un matrimonio decide separarse teniendo hijos o hijas menores que todavía están alimentándose con leche materna. Es a raíz de la ruptura de la relación matrimonial en la que existen hijos menores que aún están lactando, cuando nos preguntamos si cabe la posibilidad de denegar una custodia compartida a favor del padre por el motivo de la lactancia del menor, cuándo cabe un régimen de visita con pernoctas y si cabe una custodia compartida cuando la lactancia se prolonga y el menor es alimentado a demanda. Para llegar a este punto antes vamos a introducir y desarrollar la custodia compartida en el Derecho español.
This work is aimed at investigating the different situations that can arise when a married couple decides to separate and have children who are still breastfeeding. It is as a result of the breakdown of the marital relationship when there are children who are still breastfeeding that we ask ourselves whether it is possible to deny shared custody in favour of the father on the grounds that the child is breastfeeding, when a visiting regime with overnight stays is possible, and whether shared custody is possible when breastfeeding is prolonged and the child is fed on demand. To get to this point, we will first introduce and develop shared custody in Spanish Law.
