Abstract

La Ley 8/2021, de 2 de junio, por la que se reforma la legislación civil y procesal para el apoyo a las personas con discapacidad en el ejercicio de su capacidad jundica, ha supuesto una profunda alteración en el régimen tradicional de la capacidad jurídica y de las instituciones de apoyo a las personas con discapaci­dad. En efecto, mientras que el antiguo modelo estaba presidido por el princi­pio del mejor interés, hoy el criterio rector es el respeto a la voluntad y preferen­cias de la persona con discapacidad. El presente artículo pretende justificar que éste es el principio interpretativo que ha de presidir la aplicación de la nueva Ley y mostrar algunas de sus implicaciones prácticas, tanto en el momento de la constitución del apoyo como en la posterior actuación de la figura de apoyo

Spanish Act 8/2021, which refonns Civil and Procedure Law conceming support to persons with disabilities in the exercise of their legal capacity, has meant a deep change in the traditional regulation of legal capacity and guardianship of persons with disabilities. While the old model was based on the best interest principie, in the new one the guiding principie is respect for the will and prefe­rences of the person. The present paper tries to justify that th.is is the interpre­tative key that should govem the application of the new Law, and shows sorne of its practical implications, conceming both the provision and the execution of support.
