La inconstitucionalidad de los estados de alarma

Abstract

La situación que vivió el mundo hace ya tres años fue muy compleja, enfrentándose a un virus desconocido que provocó la declaración por la OMS de pandemia internacional. Los principales gobiernos del mundo adoptaron diferentes medidas para enfrentarse a ello; en España se declaró, en marzo de 2020, el segundo estado de alarma de nuestra historia, tras el acordado mediante RD 1673/2010 durante la crisis de los controladores aéreos. El gobierno declaró y prorrogó varios estados de alarma, consecuencia del COVID-19, algunos de ellos fueron declarados parcialmente inconstitucionales por el TC.
