Abstract

El objetivo de este trabajo consiste en analizar la aplicación de la normativa relacionada con el permiso laboral por cuidado de hijo y la excedencia por cuidado de hijo menor de 3 años. Se ha observado que algunas consejerías de las distintas Comunidades Autónomas están interpretando de manera incorrecta esta normativa al hacer incompatibles la solicitud y el disfrute de ambos permisos, a pesar de que según la normativa vigente española no son excluyentes. Para llevar a cabo esta investigación, la autora y su tutora han realizado un estudio de campo en colaboración con la Federación Española de Asociaciones de Lactancia Materna (FEDALMA), en el marco de la Cátedra Clínica Jurídica de la UMH. Las tareas desarrolladas incluyeron la organización y asistencia a reuniones con representantes de distintas Asociaciones en defensa de la lactancia en España, recopilación de información, análisis de documentos, jurisprudencia, así como el uso de cuestionarios y entrevistas para obtener información. En conclusión, se ha determinado que existe una mala interpretación y aplicación de la normativa específica sobre el permiso por cuidado de hijos y la excedencia por cuidado de hijos menores de tres años por parte de algunas consejerías. Esto resulta en la exclusión de ambos permisos, privando a madres y padres del derecho no solo a disfrutar de ambos permisos sin que se excluya uno de ellos, sino también del derecho a conciliar la vida familiar y profesional. Una necesidad crucial en este momento tan importante de cuidar y acompañar a sus hijos en sus primeros momentos de vida sin tener que renunciar a su vida profesional o recurrir a terceros para poder lograr esa conciliación.

The objective of this work is to analyze the application of the regulations related to work permission for childcare and leave of absence for childcare under 3 years of age. It has been observed that some ministries of the different Autonomous Communities are incorrectly interpreting this regulation by making the application and the enjoyment of both permits incompatible, even though according to current Spanish regulations they are not exclusive. To carry out this research, the author and tutor have carried out a field study in collaboration with the Spanish Federation of Breastfeeding Associations (FEDALMA), within the framework of the UMH Legal Clinic Chair. The tasks carried out included the organization and attendance at meetings with representatives of different Associations in defense of breastfeeding in Spain, information gathering, document analysis, jurisprudence, as well as the use of questionnaires and interviews to obtain information. In conclusion, it has been determined that there is a misinterpretation and application of the specific regulations on childcare leave and leave of absence to care for children under three years of age by some departments. This results in the exclusion of both leaves, depriving mothers, and fathers of the right not only to enjoy both leaves without excluding one of them, but also of the right to reconcile family and professional life, a crucial need at this very difficult time. important to care for and accompany their children in their first moments of life without having to give up their professional life or resort to third parties to achieve this reconciliation.
