Abstract

El escenario tecnológico –ya no tan novedoso—que caracteriza a la denominada Web 3.0 se encuentra en un creciente desarrollo que ha dado lugar al surgimiento de figuras como los crypto assets. Si bien esta tipología de activos lleva más de una década en el mercado, no ha sido hasta 2021 cuando los NFTs han experimentado un notorio auge en términos de ventas. La relevancia monetaria que dichos tokens han adquirido, ha hecho sonar las sirenas de las principales Agencias tributarias (tanto a nivel europeo como internacional) ante una posible burbuja especulativa ‘virtual’. En base a esto, surge entonces la necesidad de establecer una regularización –en la medida de lo posible armonizada—que verse sobre el control tributario y el uso del presente tópico, y que, en definitiva, reduzca el riesgo de inmunidad fiscal.

The technological scenario –not a novel topic anymore—that characterises the Web 3.0 is under an increasing development, which has allowed the emergence of crypto assets. Although this type of assets has been in the market for more than a decade, it was not until 20211 when NFTs experienced a notorious boom in terms of sales. The monetary relevance that the mentioned tokens have acquired, has caused the warning bells of Tax Agencies (at international and national levels) to ring, before a possible ‘virtual’ speculation bubble. On this basis, there is a need for a regularisation - as much as possible harmonised - of the tributary control and the use of this topic, that in hence, avoids the risk of fiscal immunity.
