La promulgación en el año 2000 de una nueva Ley de Enjuiciamiento Civil (LEC) introdujo grandes modificaciones en materia de prueba pericial. La LEC contempla su regulación como medio de prueba dentro del libro II, título I, capítulo VI y sección V, la cual es rubricada como “Del dictamen de peritos”, abarcando del art. 335 hasta el 359, ambos inclusive. A lo largo del presente trabajo se realiza un análisis pormenorizado de la prueba pericial, partiendo de su concepto, siguiendo con los requisitos que debe contener un dictamen pericial, continuando con los tipos de peritos y culminando con la práctica de la prueba pericial.

The enactment in 2000 of a new Code of Civil Procedure (LEC) introduced major changes in the area of expert evidence. The LEC contemplates its regulation as a means of proof within book II, title I, chapter VI and section V, which is initialed as "Of the opinion of experts", covering art. 335 to 359, both inclusive. Throughout this work a detailed analysis of the expert evidence is carried out, starting from its concept, following the requirements that an expert opinion must contain, continuing with the types of experts and culminating with the practice of expert evidence.
