Abstract

La institución del Tribunal del Jurado es una figura del Derecho en la que se permite a los ciudadanos su participación directa en la Administración de Justicia para intervenir en procesos penales cuyas funciones son las de jueces legos. El Jurado cuenta tanto con una dimensión constitucional como de Ley Orgánica, pues la base para su aplicación se encuentra en el artículo 125 de la Constitución Española junto con el refuerzo de la Ley Orgánica del Tribunal del Jurado de 22 de mayo de 1995, reguladora del procedimiento propio del Tribunal del Jurado, estudiando cada una de sus fases, requisitos, incompatibilidades, prohibiciones y los posibles recursos a interponer frente a las sentencias provenientes del proceso ante el Jurado, entre otros aspectos. Al ser un procedimiento especial por estar conformado por ciudadanos sin conocimientos jurídicos, la competencia se divide entre los jueces legos y el Juez técnico, correspondiendo las cuestiones fácticas a los primeros, mientras que el segundo se encarga de las cuestiones jurídicas. La decisión del Tribunal del Jurado es emitida como veredicto de culpabilidad o inculpabilidad, mientras que el Magistrado-Presidente es quien finalmente dicta sentencia con base a ese veredicto, pudiendo ser absolutoria o condenatoria.
