Hoy en día, el mundo complejo de las relaciones laborales requiere de todo un marco jurídico que sea capaz de dar respuesta a los conflictos que se producen entre empleadores y trabajadores. Para ello, la Ley Reguladora de la Jurisdicción Social, texto procesal de referencia, regula toda una serie de procesos laborales especiales. En el presente estudio trataremos de analizar la figura del despido disciplinario, así como los requisitos legalmente exigibles y los pasos a seguir para iniciar el proceso especial de impugnación de despido disciplinario ante los Tribunales. Prestaremos especial atención a la utilización de las nuevas tecnologías, en concreto, la aplicación de “WhatsApp” en el entorno laboral como un medio de comunicación entre empresario y trabajador para la notificación del despido disciplinario, y su aportación a juicio como prueba laboral.
Nowadays, the complex world of labour relations requires a legal framework that is capable of responding to the conflicts that arise between employers and workers. To this end, the Ley Reguladora de la Jurisdicción Social, the procedural text of reference, regulates a series of special labour processes. In this study we will try to analyse the figure of disciplinary dismissal, as well as the legal requirements and the steps to follow in order to initiate special proceedings for disciplinary dismissal before the Courts. We will pay special attention to the use of new technologies, specifically, the application of "WhatsApp" in the work environment as a means of communication between employer and employee for the notification of disciplinary dismissal and its contribution to the trial as labour evidence.
