Los animales de cosas a seres sintientes en la reforma del código civil

Abstract

A lo largo de toda la historia española, se ha podido evidenciar que los animales se han consolidado como un bien, sin tomar en cuenta su bienestar; estos aspectos han generado que a nivel mundial y sobre todo en la comunidad europea se reconsidere la naturaleza de los animales dentro del ordenamiento jurídico, es por ello que para el año 2021 el Código Civil español albergó su reforma legal en donde constituía a los animales como seres sintientes y demás otras cualidades que garantizan el bienestar de los animales. No obstante, el presente trabajo se va a encargar de analizar la evolución mundial a lo largo de la historia humana de los animales hasta la actualidad, tomando en cuenta el ámbito legal desarrollado en España hasta la vigente reforma legal.

Throughout all of Spanish history, it has been possible to show that animals have been consolidated as a good, regardless of their well-being, these aspects have generated that at a global level and especially in the European community, the nature of animals is reconsidered. animals within the legal system, which is why by 2021 the Spanish Civil Code housed its legal reform where it constituted animals as sentient beings and other qualities that guarantee the welfare of animals. However, the present work will be in charge of analyzing the world evolution throughout the human history of animals to the present, taking into account the legal environment developed in Spain until the current legal reform.
