Conceptualización y análisis de los delitos de odio

Abstract

El objetivo principal de este trabajo es alcanzar una visión global de los delitos odio estudiando y analizando el concepto y sus principales características para después poder comprender la regulación de los mismos en el ordenamiento juridico tanto nacional como internacional , analizando la causa que a llevado a algunos estados a dar protección a determinados grupos que siendo minoritarios sufren desgraciadamente esta lacra. Los delitos de odio actualmente están teniendo una gran presencia en los distintos medios de comunicación ya que atraves de las redes sociales se propagan y aunque hace unos años era poco probable que alguien fuera sancionado por hacer unas publicaciones expresando sus ideas en una red social, a día de hoy son cada vez más los sancionados por este tipo de delitos, por lo que el presente trabajo nos permitirá entender donde está el límite entre la libertad de expresión y la integridad de la persona viendo no sólo que opina el ordenamiento español sobre esto sino también organismos internacionales.

The main objective of this work is to achieve a global vision of hate crimes by studying and analyzing the concept and its main characteristics in order to later be able to understand their regulation in the national and international legal system, analyzing the cause that has led some states to give protection to certain groups that, being minorities, unfortunately suffer from this scourge. Hate crimes are currently having a great presence in the different media since they spread through social networks and although a few years ago it was unlikely that someone would be punished for making some publications expressing their ideas on a social network, Today there are more and more people sanctioned for this type of crime, so this work will allow us to understand where the limit is between freedom of expression and the integrity of the person, seeing not only what the Spanish legal system thinks about this, but also international organizations.
