Abstract

El presente artículo de investigación analiza la fuente de abuso y de fraude a las garantías derivadas de los derechos de asociación sindical y negociación colectiva en Colombia. Se centra en estudiar la interpretación actual del abuso del derecho de asociación sindical, puntualizando su avance jurisprudencial, abordando el origen real de la problemática con la finalidad de dar respuesta al siguiente interrogante: ¿Cuál es la fuente de las situaciones de abuso y fraude a la ley frente a las garantías derivadas de los derechos de asociación sindical y negociación colectiva? Para ello se expone el debate actual sobre multiafiliación y multinegociación. Este estudio pretende proporcionar una visión comprensiva del tema y ampliar la perspectiva sobre aquellos afectados por las prácticas en mención. (Tomado de la fuente).
