Contratos atípicos

Abstract

El libro versa acerca de los contratos atípicos que son aquellos que no tienen una consagración en la ley. En la introducción, se hace la diferenciación entre los contratos típicos y atípicos y se afirma que esta clasificación no es absoluta y obedece más a una gradación entre lo más y lo menos regulado. Los capítulos se escribieron sobre la base de una metodología de revisión bibliográfica y jurisprudencial, de manera tal que permiten a los estudiantes evidenciar los elementos de cada uno de los contratos de manera íntegra. En cada uno de los capítulos en primer lugar se define el contrato, se identifican sus elementos, las obligaciones de cada una de las partes y se busca diferenciarlos de otros acuerdos contractuales. Así, se abordan los contratos de leasing, renting, underwriting, joint venture, distribución y corretaje. En relación con el último contrato, mencionado en el Código de Comercio, se analiza si es típico o atípico lo que permite demostrar la hipótesis planteada en la introducción. (Tomado de la fuente).
