Abstract

El presente escrito se orienta a establecer un estudio conceptual de la acusación, a la luz del sistema penal acusatorio colombiano, en virtud del cual se pueda determinar si es fundamental otorgar al juez, como director del debate procesal en materia penal, la facultad de realizar un control material en la acusación, que convalide la posibilidad de avanzar a la audiencia de juicio oral, o la de variar parcialmente los postulados del Ente acusador en busca de la prevalencia de los derechos del procesado y de la sociedad.
