La problemática del hacinamiento en los centros de reclusión en Bogotá, se puede relacionar en cómo el Estado puede llegar a incurrir en una responsabilidad administrativa por la presunta vulneración de derechos esenciales trayendo consigo la ausencia de recursos o presupuesto para la infraestructura y mejoramiento de las condiciones de los reclusos, demostrando fallas en la política pública.
