Tratamiento jurisprudencial colombiano de los derechos bioculturales

Abstract

El reconocimiento que la Corte Constitucional le otorga a la cuenca del río Atrato a través de la sentencia T-622-2016, es de suma importancia, es el tercer río en el mundo objeto de derechos. Los nuevos derechos denominados Bioculturales de las comunidades étnicas para poder tener autonomía administrativa en su territorio de acuerdo con sus costumbres cimentadas en las tradiciones culturales de la población en las cercanías de la cuenca. La línea Jurisprudencial que aplica el Estado Social de Derecho busca garantizar el beneficio ambiental y cultural de los recursos naturales con las poblaciones en estado de vulnerabilidad, respetando la minería dentro del marco legal establecido. Este Reconocimiento que surge de los derechos bioculturales constituidos por tanto de la idiosincrasia que emerge al habitar esta cuenca, la tradición, costumbres, derechos y conocimientos de vida en la comunidad que son parte fundamental de la misma.
