Abstract

El presente artículo de reflexión, tiene por finalidad analizar el derecho fundamental innominado a ser intentado, junto con su reconocimiento y aplicación en el ordenamiento jurídico colombiano por medio de la acción de tutela; para lo cual, se abordarán tres ejes temáticos, el primero de ellos, consiste en realizar un estudio dogmático-histórico del surgimiento de los derechos fundamentales innominados y su definición; seguido por la revisión de la jurisprudencia constitucional colombiana, a través de la cual, se han reconocido derechos fundamentales innominados, con especial énfasis en la sentencia T-057 de 2015, mediante la cual, le fue otorgado el carácter de derecho fundamental innominado al derecho “a ser intentado” y, por último, se expondrá los motivos tenidos en cuenta en la ley adoptada por el Estado de Colorado de los Estados Unidos de Norteamérica, respecto al acceso de tratamientos experimentales por parte de pacientes terminales.
