Abstract

El capítulo intenta explicar el paso de los precedentes judiciales a la ley o, mejor, al Código de la Privacidad que está vigente en el derecho italiano. En Italia, el derecho a la privacidad nace históricamente vinculado al derecho a la imagen, que se encuentra regulado actualmente por el Artículo 10 del Código Civil de 1942, aún vigente. Es interesante recordar el caso que dio origen al debate sobre la configuración de este derecho a la personalidad y al reconocimiento legislativo del mismo. La tutela de la imagen fue regulada, por primera vez, mediante una ley de 1907 en Alemania, como respuesta al clamor suscitado por el comportamiento de dos fotógrafos que habían capturado al canciller Bismark en su lecho de muerte, contra la voluntad de sus parientes.
