Técnicas de juicio oral: un estudio crítico al interrogatorio

Abstract

La puesta en vigencia del denominado “sistema acusatorio” en el ordenamiento jurídico patrio, trajo consigo profundas modificaciones en lo procesal penal. Entre ellas, otra manera de probar con arreglo a una nueva redefinición de roles en los que compete ahora a los dos adversarios (Fiscalía y Defensa), construir y llevar por completo la verdad al juzgador, quien carece en consecuencia de iniciativa probatoria. Cobran en por tanto especial importancia dentro de esa nueva tarea de probar, las llamadas “técnicas de juicio oral”, las cuales se constituyen en la herramienta legalmente diseñada para la obtención de la verdad a través de las mismas.
