Proceso monitorio para asuntos superiores a la mínima cuantía

Abstract

El artículo de reflexión, utilizando el método de investigación descriptivo legal, busca explicar la figura jurídica del proceso monitorio en nuestro País, haciendo un recuento histórico del nacimiento de este procedimiento en la edad media, su evolución y práctica actual en Europa y Latinoamérica. Explica como y de que forma, su aplicación en la legislación colombiana, ha contribuido para resolver prontamente disputas en el cobro de sumas de dinero de mínima cuantía, disputas judiciales que componen el mayor porcentaje de litigios en Colombia. Se concluye que este procedimiento, simple y expedito, puede ser utilizado para el cobro de sumas de dinero superiores a la mínima cuantía, circunstancia que beneficia a diversos acreedores, personas naturales y empresas.
