La responsabilidad extracontractual del Estado con ocasión al COVID-19

Abstract

A finales de 2019, surgió a nivel mundial la pandemia COVID-19, que ha afectado la forma en la que los humanos realizan sus actividades diarias, En estos términos, resulta necesario analizar a través de la presente investigación si las fallas en el diagnóstico de pacientes de un hospital público, que sin hacer los protocolos debidos, confunden los síntomas presentados con los del COVID-19 y fallece por causas diferentes, aunado a la omisión del tratamiento para una dolencia distinta, puede considerarse como un evento de fuerza mayor exonerándose de responsabilidad extracontractual del Estado.
