Abstract

La Constitución de 1991 consagra de manera expresa en el artículo 90 una cláusula general de Responsabilidad, que hace referencia a la obligación que tiene el Estado colombiano de reparar los perjuicios materiales e inmateriales que haya causado. Este artículo de reflexión realiza una exploración de la jurisprudencia del Consejo de Estado, para determinar los tipos de errores judiciales que esta corporación ha contemplado en aquellos procesos de reparación directa que hacen referencia al tema
