Licencias ambientales y principio de precaución: análisis jurisprudencial del Consejo de Estado

Abstract

Las licencias ambientales son las autorizaciones mediante las cuales la autoridad ambiental, que en el caso colombiano es la Autoridad Nacional de Licencias Ambientales ANLA --, permite la realización de actividades para la ejecución de un proyecto, actividad u obra, de la cual se ha identificado produce un deterioro en el medio ambiente. Ahora bien, las características de las licencias ambientales van ligadas al principio de precaución que se orienta a la toma de medidas apropiadas para prevenir un daño en el medio ambiente, sin embargo , en Colombia aun cuando estas superan su término, las obras o proyectos se siguen ejecutando, lo que termina generando un grave peligro al medioambiente. Este artículo de investigación propone un análisis de la Sentencia 20140022201 de 2019 del Consejo de Estado, que hace referencia a la importancia de aplicar íntegramente el principio de precaución en el caso de los términos de la licencia ambiental.
