Principios del derecho internacional humanitario (DIH)

Abstract

El DIH posee un cuerpo normativo general que delimita el ámbito y el desarrollo de las operaciones militares en todo tipo de conflicto armado, lo que hace que su aplicación sea inmediata y obliga a los combatientes a causar la menor pérdida de vidas, no ocasionar males o sufrimientos superfluos o innecesarios a personas que no forman parte del conflicto o que forman parte y han sido capturadas o depuesto las armas y a no ejecutar acciones que no son necesarias para alcanzar los objetivos militares. Los principios del DIH se comportan como parámetros abiertos establecidos consuetudinariamente que, con el paso del tiempo, se han consolidado en tratados internacionales vigentes para los grupos de combatientes sin distinción alguna, los cuales tienen el deber de respetar dichas normas del DIH.
