La incidencia de los principios constitucionales de legalidad y debido proceso en la figura jurídica de las medidas cautelares innominadas

Abstract

Las medidas cautelares innominadas surgen en nuestro ordenamiento jurídico como una creación del Código General del proceso, que buscan garantizar los derechos durante el proceso del demandante. Sin embargo, su no taxatividad puede generar un alto grado de discrecionalidad en el juez, situación que eventualmente podría vulnerar principios constitucionales; por tal razón la investigación establecerá si se presentan tales menoscabos a la carta política o si las medidas cautelares innominadas se ajustan a derecho.
