Abstract

Según el diccionario de la RAE, el término fuente, del latín fons, remite en su primera acepción al “manantial de agua que brota de la tierra”, esto es, a un nicho fundante de vida. La anterior es una hermosa imagen del significado de aquello que constituye el principio, fundamento u origen de algo, en una dimensión que rebasa la mera causalidad simple. Porque evidentemente en las relaciones causales simples, ciertas variables sencillas son necesarias y suficientes para que ocurra determinado resultado, mientras que en la compleja realidad del Derecho la cosa (conducta-realidad social), para ser considerada jurídica, requiere ser considerada sub specie iuris, es decir, por su objeto formal que no es otro que lo justo. No obstante, como para el Realismo Jurídico Clásico la clave del concepto de derecho está en la analogía, es preciso aclarar que a continuación se busca describir las fuentes del analogado derecho – norma y no de todos los analogados posibles al analogado principal del Derecho, tema que se tratará en los Capítulos IV y V de este texto. En el presente apartado se abordarán las fuentes del Derecho Positivo (textos escritos) que regularmente se consideran en los países de tradición jurídica romano-germánica o continental: constituciones, leyes, reglamentos, tratados internacionales, entre otros.
