Abstract

El derecho penal internacional y los tribunales penales internacionales tienen su referente más cercano en los albores del siglo XX con el fin de la Primera Guerra Mundial, cuando parte de los acuerdos de los potencias vencedoras implicó la conformación de una “Comisión sobre la responsabilidad de los Autores de la Guerra”, conformada por 15 miembros, que trataría de violaciones al Derecho de la Guerra y la Humanidad y la responsabilidad de los poderes centrales. Al final, la Comisión recomendó: que los altos oficiales, incluido el káiser Guillermo II de Hohenzollern, deberían ser enjuiciados por ordenar los crímenes que se cometieron sobre la base de la responsabilidad de mando; y establecer un Alto tribunal con miembros de los poderes aliados.
