Populismo penal vs. punitividad

Abstract

Antes de comenzar con el estudio de las disposiciones normativas mencionadas, es necesario fijar los conceptos teóricos que se asumen en este trabajo y que serán empleados durante el trabajo. Así, la primera cuestión que debe ser resuelta es a qué se hace referencia con la denominación populismo penal. Con este nombre se apunta a un fenómeno de expansión del derecho penal en el que los políticos han tenido un papel protagónico, pues se han encargado de promover incesantes reformas a la legislación penal, “aprovechándose de la ansiedad y temor social que se empezó a generar a comienzos de la década del 70 del siglo XX por un aumento en la tasa de criminalidad y el consecuente abandono progresivo del ideal resocializador” (Velandia 2015a, 23).
