Aproximaciones a las inconsistencias teóricas del estado social de derecho

Abstract

En este trabajo se pretende aclarar y encarar algunos aspectos teóricos entre el Estado social de Derecho y el neoconstitucionalismo, con el fin de no incurrir en los reiterados equívocos de la dogmática constitucional. Para ello, primero se describen los elementos esenciales del concepto de Estado moderno y el impacto de la globalización en ellos. Luego se explica la teoría estándar en torno a diferencias entre el Estado legal de Derecho y el Estado social de Derecho. En la tercera parte del trabajo se presentan los diferentes modelos de ciudadanía, es decir, los modelos acerca del reconocimiento de los derechos de las personas. Por último, a manera de conclusión, se presentan las características generales del constitucionalismo contemporáneo en torno a la Constitución y los derechos humanos y se plantea que los enunciados normativos “tal como aparecen en las Constituciones y tratados internacionales” no son suficientes para regular los comportamientos de las personas, por lo que se requiere la interpretación e implementación judicial de los derechos en los casos concretos con el fin de adaptar el Derecho a la realidad social.

This paper is intended to clarify and face some of the theoretical aspects of Social Rule of Law and neo-constitutionalism in order to avoid incurring the usual equivocal statements of constitutional dogmatics. To that effect, we first describe the overriding elements of the Modern State concept and how globalization has had an impact on it. Next, we explain the standard theory regarding the differences between the Rule of Law and the Social Rule of Law. The third part of the paper presents the various models of citizenship, that is, models related to the acknowledgment of people’s rights. To conclude, we present the general characteristics of contemporary constitutionalism with regard to Constitution and Human Rights. There we suggest that the normative statements ¬–the way they appear in Constitutions and international treaties- are not enough to regulate people’s behaviors which makes it a requirement to make a legal interpretation and implementation of rights in the specific cases in order to adapt Law to social reality
