Las medidas cautelares innominadas y su relación con el principio de legalidad

Abstract

El presente trabajo de investigación abarca la definición de las medidas cautelares innominadas, introducidas al ordenamiento jurídico Colombiano por el Código General del Proceso. Junto con la definición de este tipo de medidas, se analizará si su aplicación en los procesos que se adelantan en las distintas jurisdicciones agreden de una u otra manera, el principio constitucional de legalidad al no estar contempladas expresamente en la ley. Igualmente se analizan las posibles consecuencias que tienen este tipo de medidas al ser aplicadas en cualquier momento del proceso.
