Estabilidad laboral reforzada de las personas pre-pensionadas en Colombia: extensión de la protección constitucional más allá del retén social
El artículo genera un análisis normativo y jurisprudencial, relacionado con el tratamiento jurídico dado en Colombia al pre-pensionado, conforme a su expectativa próxima de adquirir el estatus de pensionado. Su desarrollo lleva a plantear que, conforme a los más recientes tratamientos jurisprudenciales, este se acerca a una condición de estabilidad laboral reforzada, equiparable al concepto de retén social.
