Responsabilidad del estado ante las empresas de servicios públicos domiciliarios por fallas en la regulación

Abstract

La Ley 142 de 1994 estableció el Régimen de Servicios públicos domiciliarios en Colombia que abrió paso a la creación de entes autónomos denominados comisiones de regulación encargadas de expedir la regulación económica para la prestación de servicios públicos domiciliarios. Los errores en la regulación expedida por dichas comisiones pueden representar para las empresas reguladas grandes pérdidas económicas, en ese sentido resulta relevante presentar un análisis de la eventual responsabilidad que podría llegar a tener el estado por las fallas o los errores que se presenten en la expedición de la regulación económica en materia de servicios públicos domiciliarios en Colombia.
