[ES] En este trabajo de investigación, nos basaremos en la distinción entre el derecho sancionador administrativo y derecho penal, encontramos que existe en la actualidad una serie de problemáticas no resueltas, en cuanto a la potestad de la administración para darle mayor libertad al legislador, en cuanto a los principios pues encontramos una equivalencia entre ambos derechos, pues los dos hacen uso del mismo ordenamiento punitivo, y hacen uso de igual forma del ius puniendi del Estado. Realizaremos un análisis en profundidad de los principios y de la perspectiva de los mismos con respecto a la relación existente entre ambos derechos, existe una clara diferenciación cuantitativa en cuanto a los ilícitos penales y administrativos según sentencia el Código Civil, pero también existe una diferenciación cualitativa al respecto de los objetivos y la finalidad de cada ilícito, siempre y cuando la administración nunca haga uso de la pena privativa de libertad, como refleja la Constitución en su art. 25.3.

[EN] The administrative sanctioning law and criminal law have got some differences; currently we find there are a lot of unresolved issues, in terms of the administration ́s powers to give greater freedom to the legislator; as to the principles, we find an equivalence between both rights, because both make use of the same punitive order, and they use the same way of the State ius puniendi. We will carry out an in- depth analysis of the principles and perspective of them with respect to the relationship between both rights; there is a clear quantitative differentiation regarding criminal and administrative offenses according to the Civil Code, but there is also a qualitative differentiation with respect to the objectives and purpose of each crime, as long as the administration never makes use of the penalty of deprivation of liberty, as it is reflected in the Constitucion in its article 25.3.
